1. These terms
What these terms cover.
These terms pertain to how we supply goods to you, with 'us', 'we', or 'our' referring to your store of preference for the collection of goods. It is vital to read these terms before placing an order with Brew Haven, as they outline how we provide goods and services. This includes information regarding how we handle inquiries and personal details. We encourage website visitors to contact us regarding any questions or concerns.
2. Our contract with you
How we will accept your order.
Any orders placed through our website will be acknowledged via email. You will also be notified once your order is ready for pickup or delivery.
How we may contact you. If we need to get in touch with you, we may do so using the provided contact information, whether by phone, email, or post.
Availability of goods and substitutions. The availability of goods online may vary. If an item is unavailable, we may substitute it, which can potentially affect the price of your order (see clause 12). Customers will be notified of any substitutions and the total price in your collection email. You will also have the option of refusing the substituted goods and requesting a refund.
Your order number. We will provide you with an order number once your order has been accepted.
We only sell to the UK. We exclusively serve customers within the U.K. through our website.
3. Our goods
It is important to note that product images on our website are for illustrative purposes only. Although we strive for utmost accuracy, variations in website material may occur. Packaging for Brew Haven goods may also differ from what is shown on our website. We make reasonable efforts to ensure the accuracy of all product information but do not accept liability for inaccuracies.
4. Your rights to make changes
Don't hesitate to contact us if you need to make changes to your order. We will confirm if the requested changes are feasible and will keep you updated with any price adjustments or timing changes. Once orders are paid for, they cannot be altered.
5. Click and collect
You must provide a valid form of ID as well as a signature when collecting your order.
6. Your rights to end the contract
You can always end your contract with us.
You always have the right to terminate your contract with us at any time. Your rights upon termination are dependent on the condition of the goods you purchased, our performance, and whether you are an individual or business customer.
Ending the contract because of something we have done or are going to do. If you're ending the contract for any one of the following reasons, it will be terminated immediately:
- There is an upcoming change to goods or terms you did not agree to
- There's an error in the price or description of the goods
- There's risk of delayed supply due to events beyond our control
- Supply of the goods has been suspended
- You have the legal right to terminate the contract due to our wrongdoing
7. How to end the contract with us
You can cancel your order within 14 days after collection for an exchange or refund by notifying us through our Cancellation Form. Certain goods, such as those past their expiration date, chilled or frozen items, and goods sealed for hygiene reasons cannot be returned.
Refunds, including any collection charges, will be processed within 14 days of receiving the returned items.
8. If there is a problem with the goods
If you would like to report issues with the goods, make sure to contact our customer service via telephone or the email address provided in your acknowledgement email.
9. Your rights with respect to defective goods if you are a consumer
We operate under a legal obligation to guarantee that goods conform to the order terms and the item descriptions on our website. If any discrepancies are found upon collection of your order, do not accept it. Under certain circumstances, you can request a refund within 30 days and within six months if items can't be replaced.
10. Your rights in respect of defective goods if you are a business
For business customers, we warrant that goods collected before their 'use by date', 'best by date' or 'BBE' are as described, free from defects, offer satisfactory quality, and fit for their intended purpose. If you notify us about any issues during the warranty period, we may repair, replace, or refund that at your request.
11. Price and payment
Where to find the price of goods. The price of goods, including VAT, is determined by the price listed on our website at the time of purchase. Subsequent price changes will not affect your order unless otherwise specified. Goods sold by weight. For goods sold by weight, such as fruit and vegetables, slight variations in price may occur. These variations can cause fluctuations in pricing, whether higher or lower than initially stated. Changes in VAT rate. We will adjust the VAT rate you pay if it changes between your order date and the time you collect your order. However, this doesn't apply if you have already paid in full before the change takes effect. Incorrect price. If we mistakenly price goods and you place an order under that price, we retain the right to cancel your order, refund your payment, and retrieve any goods provided to you. Carrier bag charge. You will be charged for carrier bags used to pack your items. This charge will be displayed before finalizing your order. How to pay. You can pay for your order using either Visa or Mastercard. Your method of payment will be charged at the time you place your order. Our right of set-off if you are a business customer. As a business customer, you must pay all amounts owed under these terms in full, without any deductions or withholdings, except as required by law for tax purposes. What to do if you think an invoice is wrong. If you believe an invoice is incorrect, please notify us immediately. No interest will be accrued until the dispute is resolved. After this, any pending interest will be charged to the correct invoice amounts from the original due date.
12. Our responsibility for loss or damage suffered by you if you are a consumer
We are responsible to you for foreseeable loss and damage caused by us. We remain liable for foreseeable loss or damage caused by our failure to meet these terms with reasonable care and skill. This does not pertain to any unforeseeable losses. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. Brew Haven fully acknowledges liability where excluding or limiting it would be unlawful. This includes instances of negligence leading to death or personal injury, fraud, or other legal protections against liability exclusions. We are not liable for business losses. We do not accept liability for any losses incurred in a business context. For those who are consumers, our goods are intended solely for domestic use. Any commercial or business use limits our liability as outlined in clause
13. Our responsibility for loss or damage suffered by you if you are a business
Except as specified in clause 1, we exclude liability for death or personal injury caused by negligence, including fraud and breach of implied terms under the Sale of Goods Act 1979 or Supply of Goods and Services Act 1982, defective goods under the Consumer Protection Act 1987, as well as any unlawful exclusion of liability.
We do not accept liability for indirect or consequential losses, and our total liability under any contract is limited to the amount of the order placed through our website.
14. Other important terms
We may transfer this agreement to someone else. Our rights and obligations under these terms may be transferred to another organization. Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract and its terms are only between you and us. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in effect. If we delay in enforcing this contract, we can still enforce it later. We reserve the right to enforce this contract at a later date even if we do not immediately insist on compliance or take action against any breaches by you. Which laws apply to this contract and where you may bring legal proceedings if you are a consumer. This contract is governed by English law. If you are a consumer, you have the right to bring legal proceedings regarding the goods to the English courts. Moreover, residents of Scotland and Northern Ireland may also choose to bring legal proceedings in their respective courts or into the English courts. Which laws apply to this contract and where you may bring legal proceedings if you are a business. For businesses, disputes or claims stemming from our contract, including non-contractual matters, are governed by English and Welsh law. This includes exclusive jurisdiction of the courts of England and Wales to settle such disputes or claims.
